HHS sole-sources Anthropic Claude as stopgap
The SAM.gov notice claims Claude is the only tool that can meet the department's needs (for a chatbot) while a competitive procurement is still in the works.
TL;DR
HHS posted notice on SAM.gov that it intends to sole-source an award to Anthropic for Claude services as an "interim" continuity measure while it prepares a competitive multiple-award BPA. The notice asserts Claude is uniquely capable of meeting the department's requirements, chat, drafting, summarization, data-analysis, administrative controls. HHS rolled out Claude departmentwide in December 2025. The sole-source comes as Anthropic's OneGov $1 deal with GSA expires October 31.
The Department of Health and Human Services disclosed Monday on SAM.gov that it intends to sole-source an award to Anthropic for Claude services, calling it "a limited continuity of services award" while the department readies a competitive procurement, the "HHS Enterprise Frontier SI Models and Advanced Features multiple-award BPA."
The notice states that "the capability is specific to one provider: Claude is Anthropic's proprietary model family, and the requirement is continuity of the existing Claude deployment already." HHS listed the required capabilities as chat, drafting, summarization, data-analysis workflows, application access, and administrative controls.
HHS has been a Claude user since at least December 2025, when Deputy Secretary Jim O'Neill announced the tool departmentwide, encouraging staff to use either Claude or ChatGPT or "ask both and compare the responses." The department also listed Claude use cases in its 2025 AI inventory, and Claude powered the FDA's Elsa chatbot, though Fierce Biotech reported that the agency began transitioning Elsa to Google's Gemini earlier this year following the Trump administration's governmentwide ban on Anthropic.
That ban, issued via Truth Social in February 2026, stemmed from a clash between Anthropic and the Pentagon over military-use restrictions in the company's terms of service. The legal dispute is ongoing, but the Pentagon appears to remain at odds with Anthropic while other agencies have moved toward reconciliation. HHS Deputy Chief AI Officer Arman Sharma emailed staff in February that the agency would disable enterprise Claude; the present sole-source notice suggests that decision has been reversed or superseded.
The sole-source arrives as Anthropic's OneGov deal with GSA (which offered Claude to all three branches of government for $1) expires October 31. OpenAI has already announced a post-OneGov shift to consumption-based pricing.
Jessica Tillipman, associate dean for Government Procurement Law Studies at George Washington University, told FedScoop the notice "reeks of … 'this is going to be a pain, so let's just keep it going'" and that the listed capabilities describe "fairly general chatbot services", making the claim that only Claude can provide them a questionable sole-source justification. Tillipman has written previously on vendor lock-in risk in AI procurement.
