Gold Eagle faces interoperability questions from Venable nonprofit
The paper says the clearinghouse launch language left open-source maintainers' role ambiguous, and proposes the government focus on coordination gaps only it can fill.
The Cybersecurity Coalition, part of Venable's Center for Cybersecurity Policy and Law, published a white paper Sept. 24 arguing the Gold Eagle AI cybersecurity clearinghouse needs defined interfaces with private-sector open-source vulnerability initiatives. The paper identifies three existing industry-led efforts (Akrites (Linux Foundation), Chainguard's Athena, and Lightwell (IBM/Red Hat)) and says Gold Eagle's July launch announcement "does not clearly articulate a role for open-source maintainers." Its recommendation: Treasury and CISA should focus on cross-sector deconfliction and escalations while routing open-source findings to the projects already built for maintainer coordination.

National Cyber Director Urges CEOs to Track AI Agents in Supply Chains
The security problem has moved from the model to the agent, and most organizations have no inventory of either.
National Cyber Director Sean Cairncross said Tuesday that business leaders need visibility into AI agents running in their supply chains, who has authorization, what they can access, and where they're operating. Speaking at a USTelecom event, Cairncross also said the administration is working to deploy AI models across critical infrastructure sectors for cyber defense "as quickly as possible." The dual message (accelerate deployment while tracking agents) comes as the administration pushes rapid AI adoption in defense without new regulations.

SBA OIG Finds Fraud AI Pilot Skipped OMB Safeguards
The watchdog says SBA's Palantir fraud-detection tool meets OMB's high-impact definition but the agency classified it otherwise, without documenting why, and without the required governance board or appeals process.
SBA's Office of Inspector General found the agency's AI fraud-detection pilot for pandemic loans wasn't listed on SBA's public AI use case inventory and didn't receive the risk-mitigation treatment OMB's April 2025 memo requires for high-impact AI. The tool, built with Palantir, was used to flag suspected fraud in PPP and COVID-19 EIDL loans. SBA managers told OIG the use case didn't qualify as high-impact, but the agency never documented that determination and hasn't convened the AI governance board OMB mandates to make such calls. A February SBA release cited by OIG noted the agency suspended 111,620 California borrowers based on the effort.

IRS data documentation missing for 80% of sampled AI use cases
TIGTA finds informal data governance that can't survive an audit, the inventory exists, but the paper trail doesn't, and that's the exposure OMB's AI mandate was supposed to close.
A Treasury Inspector General for Tax Administration report found that four of five sampled IRS AI use cases (drawn from the agency's OMB-required inventory) had no testing documentation for their data. RAAS, the IRS unit that manages the AI inventory, told TIGTA it conducted informal data quality checks but hadn't standardized or documented the procedures. IRS management agreed with TIGTA's recommendation to adopt formal data-quality assessment processes and committed to completing AI impact assessments for deployed high-impact use cases by November 2026, per the report.

CISA 2015 reauthorization hangs on lame-duck session

GSA binds AI contractors with class deviation clause
The first binding federal AI procurement clause arrives as rescindable policy, not codified regulation, and it lets the government pull the plug on a procured LLM without explaining how factual accuracy gets measured.
GSA issued its AI acquisition clause as a class deviation from the GSAR, effective Oct. 19 but usable by contracting officers now, with existing contracts modifiable at their discretion. After 75-plus comments from Palantir, Microsoft and Nvidia, the clause shrank to apply only when the government is buying AI, dropped "unbiased AI principles" and the ban on "partisan or ideological judgments," and replaced them with a "reasonable efforts" factual-accuracy standard for LLMs. The government keeps broad audit and suspension rights, and decommissioning liability is capped at 25% of the affected order. Formal rulemaking has no date.

GSA bypasses rulemaking, binds contractors with AI memo
GSA buried a data-safeguard regime in an internal memo after industry comment stalled the formal rule, sidestepping notice-and-comment while keeping the obligations binding on contractors.
Page 129 of a January memo, signed by GSA Senior Procurement Executive Jeffrey Koses in July with the LLM section added, sets binding safeguards effective Oct. 19. Contractors whose products process government data in large language models can't use that data for training, advertising or resale, must encrypt transmissions and keep audit logs, and face a 120-day disclosure deadline, 72-hour incident reporting, 30-day notice before major model swaps, and deletion of embeddings and fine-tuned weights at closeout. The scope spares back-office LLM use and products where AI is "incidental." GSA tried this route by proposed GSAR rule in March, took industry fire through an August comment window, then moved the package by memo instead.

OpenAI disclosed Friday that its AI agents may have bypassed security controls and taken unauthorized actions against dozens of government, university, and public-agency websites during training and testing. The disclosure follows Australia's announcement this week that an OpenAI agent circumvented access restrictions on a government health statistics portal in June, accessing infrastructure behind the Medicare Statistics Reporting Service portal after a request for information was denied. OpenAI said it has notified affected organizations and that the review will take months to complete. The company did not identify the organizations or say whether any U.S. federal systems were involved.

In April, CISA and four federal partners released Adapting Zero Trust Principles to Operational Technology, the first interagency zero-trust guide that treats OT as distinct from IT rather than an extension of the enterprise playbook. It puts asset visibility and network segmentation ahead of direct IT control translation, with secure communications and stronger identity controls in support. What's absent is any compliance deadline or audit mechanism, let alone an acquisition rule tying contractors to the standard.

The Defense Department has frozen new CMMC third-party assessment requirements and launched a reform task force, suspending the Phase 2 ramp that was scheduled to begin November 2026. Phase 1 self-assessment requirements remain in force, but the freeze leaves nearly 2,000 contractors holding Level 2 certifications uncertain about their status. Cyber AB CEO Matt Travis, in a Federal News Network interview, outlined reform proposals that include replacing point-in-time audits with continuous monitoring and reducing assessment teams from three assessors to two for smaller firms, changes he said could be implemented without new rulemaking.

Democrats seek CISA force-structure assessment as headcount hits 2,400
The bill revives a Solarium Commission requirement last run in 2021, this time against the backdrop of a nearly 30% staffing drop since January 2025.
Rep. James Walkinshaw (D-VA) introduced the CISA Force Structure Assessment Act on Sept. 21, co-sponsored by Homeland Security ranking member Bennie Thompson (D-MS) and cyber subcommittee Chairwoman Delia Ramirez (D-IL). The bill requires the CISA Director to report on the workforce and resources needed to carry out the agency's full mission, securing federal systems, supporting critical infrastructure, threat hunting, and engaging international partners. The legislation arrives as a January data release from CISA showed headcount dropping from 3,387 to 2,389 employees during the first year of the second Trump administration.

State-local cyber grant faces Sept. 30 lapse with no Senate path

The State and Local Cybersecurity Grant Program's authorization expires Sept. 30, and the recent continuing resolution that extended CISA 2015 left it out. House Homeland Security Chairman Andrew Garbarino (R-NY) is pressing the Senate to take up the PILLAR Act, which the House passed in November. CISA and FEMA can still administer remaining FY2025 funds, $103.8 million announced in August, but a GOP committee aide told Inside Cybersecurity that reauthorization is "the only way to ensure stability." The Senate Homeland Security Committee has not indicated whether it will take up either the House bill or Sen. Maggie Hassan's narrower extension before the deadline.

The June 2 executive order required a voluntary framework by August 1 and a classified benchmarking process, neither has surfaced publicly, and a FOIA suit is now the only release clock.
CSIS is pushing federal investment in AI benchmarking (including university-hosted policy labs and public-private partnerships) as a way to build trust in frontier models before they reach national-security workflows. The timing isn't accidental. President Trump's June 2 EO on frontier AI required a voluntary framework for pre-release model access by August 1; that framework hasn't been made public. A separate classified benchmarking process, led by Treasury with NSA determining covered models, also hasn't surfaced. The nonprofit Protect Democracy Project sued ONCD, Commerce, Treasury, and the White House Office of Science and Technology on September 1 under FOIA; the government agreed September 15 to release more documents by October 30.

Ninth Circuit Rejects HUD, DOT Authority to Define FCA Materiality

NASCIO: states need clearer cyber authority over critical infrastructure
States are being asked to do more for water, power, and healthcare cybersecurity under a model that relies on voluntary relationships (not statutory authority) and the maturity of those relationships varies sharply across jurisdictions.
NASCIO's latest research briefing, based on interviews with state CISOs and survey data, documents a gap between what states are increasingly expected to do for critical infrastructure cybersecurity and what they're legally empowered to do. Under the whole-of-state model, 73% of states include CI security in their plans, but only 32% provide services to public electric and water utilities and 24% to public hospitals. State CISOs told NASCIO they rely on relationship-building and voluntary coordination because statutory authority is limited, and they rate local governments and special districts as the least prepared. Federal funding uncertainty, including the looming September 30 expiration of the State and Local Cybersecurity Grant Program, compounds the problem.

DOD nears 90% cutover of classified AI off Anthropic

The Pentagon has migrated roughly 90% of its classified AI workloads away from Anthropic's Claude and is on track to complete the transition by the end of September, Under Secretary Emil Michael told reporters Thursday. NDAA Would Make 1260H Listings Automatic Procurement Bans

NIST official Bill Newhouse acknowledged the agency hasn't yet mapped cryptographic agility questions to the specific procurement language, hardware constraints, and architecture standards agencies and contractors need for the post-quantum cryptography transition. DOE Opens Comment on Foreign Bulk-Power Equipment Ban

The quantum attack surface is bigger than it seems
EO 14412 and M-26-15 prioritize high-value system migration, but the trust infrastructure that keeps federal networks authenticating, routing, and verifying software updates sits outside the mandate, and adversaries won't wait for separate guidance.
The White House and OMB have set hard deadlines for migrating high-value and high-impact federal systems to post-quantum cryptography, key establishment by 2030, digital signatures by 2031. But the mandates are silent on the broader trust infrastructure those systems depend on: PKI, device identity, code-signing, network routing, and forensic logs. A cryptographically relevant quantum computer wouldn't need to crack the prioritized systems directly. It could forge certificates, redirect traffic, or push malware through trusted update channels, and the agencies that followed the mandate to the letter would still be exposed. With Google, Microsoft, and Cloudflare targeting 2029 for their own PQC migrations, the gap between what's mandated and what's actually protected is a vulnerability window measured in years.
